1.1 The Executor renders to the Customer paid services of distance learning on the course "Cyber Detective" (by means of Internet - connection) (hereinafter also - the Course).
1.2 The Executor charges for the services according to the cost of the Customer's chosen tariff specified on the pages of the Course on the Executor's website - https://academy.cyberyozh.com/courses/antifraud/en (hereinafter - the Course Website) or on specialized websites on the Internet.

2.1 According to the Civil Code of the Azerbaijan Republic, in the jurisdiction of which the Executor acts, the unconditional acceptance of the terms of this Agreement is the payment by the Customer for the services provided by the Executor.
2.2 Acceptance of the present public offer by the Customer is a fact of complete and unconditional acceptance of the conditions given below and the acceptance of the public offer is payment of the order for educational services through the payment system on a site (for individuals) or to the account of the Executor (for legal entities).
2.3 Performing actions on the acceptance of this public offer agreement, the Customer confirms its legal capacity and capability, the Customer reaches the age of majority, as well as the Customer's legal right to enter into contractual relationships with an individual entrepreneur.
2.4 This contract on rendering paid services for distance learning on the course "Ethical Hacking. Hacking of antifraud systems" is concluded in a special way: by acceptance of this public offer, containing all essential conditions of the Agreement, without signing by the parties, or with signing of this Agreement bilaterally at the request of the Customer.
2.5 Individual or legal entity, who accepts this offer, becomes a Customer (acceptance of the offer is tantamount to concluding an agreement on the terms and conditions set forth in the offer).
2.6 In case of the Customer's demand to sign by parties of this Agreement, the Customer fills the necessary details of the Agreement and sends a scan of the Agreement signed by him to the Executor's e-mail support@cyberyozh.com. In its turn, the Executor signs the scanned copy of the Agreement received from the Customer and sends it by e-mail in return.
2.7 The Parties recognize documents (including the correspondence itself) received by means of facsimile, electronic or other communication, including using information and telecommunication network of the Internet, as admissible written evidence.
2.8 This Agreement has legal force in accordance with the Civil Code of the Azerbaijan Republic and is equal to the agreement signed by the parties.
2.9 After completing the registration form (hereinafter - the Application) for the provision of paid distance learning services on the Course, the information provided in the Application for training is the basis for the conclusion of the Agreement between the Contractor and the Client. In this case, the Customer (a party to this Agreement) means any person specified in the payment document on whose behalf the payment is made under this Agreement (the payer). If the payment is made for a third party (and this is evident from the payment document or any other legitimate document), then the person for whom the payment is made is the Customer under this Contract.
2.10 If the Customer does not agree with any paragraph of this public offer, he is invited to withdraw from the contract-offer.

3.2 Acceptance of the offer - full and unconditional acceptance of the terms of the offer by the Customer's actions expressing the intention to use the Contractor's services to obtain educational services and access to training materials on the Course site.
3.3 Course site - a publicly accessible for individuals and legal entities Internet site located in the Internet at https://academy.cyberyozh.com/courses/antifraud/en.
3.4 Contract - an agreement between the Contractor and the Customer for the provision of paid distance learning services on the course "Ethical Hacking. Hacking of anti-fraud systems" which is concluded by accepting this public offer.
3.5 Customer - a User who has carried out the acceptance of the offer and is thus a Customer of the Contractor's services to the concluded Agreement.
3.6 User - an individual who is registered on the site, or unregistered visitor who has navigated to one of the Executor's site to get the information for personal use, and later becomes a Customer in case of his interest in the Executor's services after he fills the request.
3.7 The Order - the Customer's duly executed request for the service on the paid distance education course.
3.8 Offer - this document "Public offer agreement (adhesion agreement) of rendering services of paid distance learning on the course "Ethical Hacking. Hacking of antifraud systems" (by means of Internet-connection)", published in the Internet on one of the Contractor's web-sites.
3.9 Registered User - a legally capable adult person who has the legal right to enter into a contractual relationship with the Contractor.
3.10 Support service - Executor's service that controls the incoming Orders and gives the feedback to the Users and Customers at support@cyberyozh.com.
3.11 Course module - thematic block of the Course "Ethical Hacking. Hacking Anti-Fraud Systems", consisting of lesson(s). The list of Course Modules available in accordance with the selected Tariff is presented in the Course Program on the Course website. Lessons can be in a variety of formats, including: video format (studio recording and screencasts), live webinar, text lessons and instructions, audio podcasts (news or answers to popular questions), and other formats and combinations thereof.

4.1.1 Provide services for paid distance learning course "Ethical Hacking. Hacking of anti-fraud systems" (via Internet-connection) (hereinafter - services), within the selected rate of the Course in accordance with the program and terms defined for each of the rates of the Course on the Course Website.
4.1.2 After the confirmation of the fact of payment the Executor is obliged to provide the Customer access to the educational and methodological materials of the Course within 3 days after the notification from the Executor about the start of the Course.
4.1.3 Consider the information received from the Customer as confidential and not to disclose this information to third parties without the Customer's consent. In this case, the Contractor undertakes to process the received data only for the purpose of the Contract execution.
4.1.4 Advise the Customer on organizational and technical issues of training, webinars and other events, as well as other issues of training on the Course through the support service on the Executor's website.
4.1.5 If the Course fare chosen by the Customer contains the possibility of feedback with the teacher, the Executor is obliged to provide this connection within the framework of the entire duration of the training on the Course.
4.1.6 If the Course tariff chosen by the Client implies a staggered presentation of material, i.e. each subsequent material is given to the Client only after the previous material has been completed, the Executor is obliged to give the next material only after making sure that the Client has successfully mastered the previous stage.
4.1.7 If the Executor has provided the registration data for access to the Course materials to the Client within the given deadline to the e-mail address specified by the Client during registration, then the obligations of the Executor are considered fulfilled and the services under this Agreement are considered to be rendered.
4.1.8 If the Executor (including in the person of the tutor) got in touch with the Customer at the previously appointed time and the Customer is absent, the obligations of the Executor are considered fulfilled and the services to this Agreement are considered as rendered.
4.1.9 In case the Customer has not mastered the full program of the Course in the preset time, which is specified in the course program, the obligations of the Contractor are considered fulfilled and the services under this Agreement are considered to be rendered in full. The Contractor has the right to provide the Customer with additional time of access to the Course materials for a separate fee as a separate service. If the period of access to the course materials is not stipulated in the course description at the time of the Customer's application, the access to the course materials ceases 180 days after the end of the course.
4.1.10. In case of non-performance or improper performance of the obligations under this Agreement by the parties, they shall be liable as provided by the Civil Code of the Azerbaijan Republic and other normative legal acts of the Azerbaijan Republic.

4.2 Obligations of Customer
4.2.1 Fill in the registration form for the selected course tariff. Specify at registration the correct data for information on access to training materials.
4.2.2 To pay for the services of the Executor in the amount and terms specified on the Executor's site or on the specialized sites on the Internet.
4.2.3 Perform all the necessary activities to prepare before the start of the course, which are specified in the course program.
4.2.4 It is forbidden to transfer to third parties the authority to access the Course materials. The Customer undertakes to use the Course materials only for personal use. In case it is necessary to provide access to the Course materials to third parties, the Client undertakes to obtain official permission from the Contractor in writing (possibly via e-mail) under the Contractor's conditions.
4.2.5 Not to use the information received from the Contractor in ways that can cause damage to the interests of the Contractor. Including not to use materials of the Course in its training programs or courses, not to distribute course materials in any part of them on the Internet. Responsibility for compliance with the legislation on copyright and other exclusive rights is regulated by the Civil Code of the Azerbaijan Republic.
4.2.6 It is forbidden to transfer to third parties or misuse the email address of the Contractor or other contact information for communication with the Contractor. It is allowed to use the contact data as well as the email address of the Contractor only to solve the issues related to the educational process or organizational issues.
4.2.7 The Customer is obliged to complete the Course within the deadline stipulated in the conditions of the tariff of the Course chosen by the Customer.
4.2.8 The Customer undertakes to complete all the tasks on the Course during the period of the Course.

4.2.9 The Customer is obliged to comply with other conditions of the course specified on the Executor's website.

5.1 The Customer has the right to:
5.1.1 Choose the rate of the Course by sending the appropriate application (or by filling in the registration form) on the Executor's website or the Course page on the Internet.
5.1.2 Demand information from the Provider on the organization and maintenance of the proper provision of services.
5.1.3 To demand the proper and timely provision of services by the Executor.
5.1.4 Demand the refund for the course in order and on terms specified in this Offer.
5.1.5 Contact the Contractor on all matters relating to the provision of services, as well as ask questions related to the provision of services.
5.1.6. get full and accurate information about the assessment of his knowledge and skills, as well as about criteria of this assessment.
5.1.7. to use all the materials provided by the Provider on the Course, during the development of the program, as well as after taking the Course for the period specified in p. 4.1.9 of the Offer.
5.1.8. use additional services not specified in this Agreement and not included in the course provided by the Contractor on the basis of a separately concluded agreement.
5.2 The Executor has the right to:
5.2.1 Independently determine forms and methods of rendering services on the basis of requirements of the legislation of the Azerbaijan Republic, as well as specific conditions of the Contract-Offer taking into account wishes of the Customer.
5.2.2 Determine evaluation system, forms and procedure of evaluation at rendering of services at its own discretion.
5.2.3 Independently determine the composition of specialists providing services within the framework of providing access to the Course.
5.2.4 Demand payment for the rendered or provided services.
5.2.5. Refuse to fulfill the Contract on condition of reimbursing the Customer for the part of the Course not taken in accordance with the legislation of the Republic of Azerbaijan.
5.2.6 Receive from the Customer any information required to perform its obligations under this Agreement-offer. In case of non-submission or incomplete or incorrect presentation of information by the Customer, the Contractor has the right to suspend its obligations under the Agreement-offer till the presentation of the necessary information.
5.2.7 Provide other services on separately concluded agreements with the Customer.
5.2.8. The Executor has a right to terminate the Agreement unilaterally in cases of
- breach of terms of payment for the Services by the Customer or untimely payment;
- Repeated (two or more times) violation by the Customer of the rights and legitimate interests of other students, the Executor and its representatives, the process of providing services, the schedule of classes;
- one-time use of the information received from the Provider in ways that led to any damage to the property and reputational interests of the Provider.

6.1 The cost of the Course is indicated on the pages of the description of the rates of the Course. Links to the description pages are on the Course website https://academy.cyberyozh.com/courses/antifraud/en.
The cost of the Course at the rate is made up of:
- The cost of the Course Modules.
- The cost of the services of the Provider within the tariff.
Rate "JUNIOR".
1) Each Module of the Course at the rate JUNIOR costs 10,00
of the total Course cost. The cost of one Module includes the price of all materials that relate to the topic of the Module.
2) The cost of the Contractor's services within the tariff is 40,00% of the total cost of the Course.
The Contractor's services within the tariff include: organization of live webinars within the Course Modules, feedback of Course Tutors, checking assignments within the Course Modules, answering the Customer's questions.
Rate Middle
1) Each Module of the Course at the tariff "Middle" costs 7,5%
of the total Course cost. The cost of one Module includes the price of all materials that relate to the topic of the Module.
2) The cost of the Contractor's services within the tariff is 40,00% of the total cost of the Course.
The Contractor's services within the tariff include: organization of live webinars within the Course Modules, feedback of Course Tutors, checking assignments within the Course Modules, answering the Customer's questions.
Senior Rate
1) Each Module of the Course at Senior rate costs 6%
of the total Course cost. The cost of one Module includes the price of all materials that relate to the topic of the Module.
2) The cost of the Contractor's services within the tariff 40,00% of the total cost of the Course.
The Contractor's services within the tariff include: the organization of live webinars within the Course Modules, feedback of Course supervisors, checking assignments within the Course Modules, answering the Customer's questions.
6.2 Payment for services performed by the Customer on the Executor's website or independently with the help of services provided by third parties by transferring funds to the account of the Executor, according to the details specified in section 11 of this public offer.
6.3 Payment is made in the order of 100% prepayment in the amount according to the selected rate of the Course. By agreement with the Contractor, received in writing, the Customer has the right to receive an interest-free installment payment on the conditions provided by the Contractor at the request of the Customer.
6.4 The Customer is obliged to pay and confirm the fact of payment before the date of start of services by contacting the support service of the Executor.
6.5 In case of lack of payment confirmation in terms specified by the Executor, the Customer does not get access to the materials of the Course.
6.6 The cost of the Executor's services is calculated in US dollars.

7.1 The Agreement comes into force from the moment of the Customer's payment for the educational services provided to him by the Executor, or approval of the application on the page of the course paid by the Customer (according to the time of the event occurring later).
7.2 The Customer registers the user account in the training system independently. Access to the account is opened at the moment of the start date of the Course or within one day after the Customer has paid for the course (in accordance with the time of the event occurring later).
7.3 The term of this Agreement is set in accordance with the rate of the Course chosen by the Customer. The maximum term of the Course program is set in the Course program. All messages left during the Course are stored in the Customer's personal office for the duration of the Agreement.

8.1. If the Customer has any unforeseen (force majeure) circumstances (fire, acts of war, decisions of higher state authorities, strikes, illness, moving, urgent business trip, lack of access to the Internet and / or others) and is forced to interrupt the passage of the Course, access to the Course materials can be suspended based on a personal statement in the form of an application to the Executor support service not later than 5 days after the occurrence of these circumstances. In this case, the Customer's account is not deactivated, but the access to the materials and lessons is suspended. The term of suspension is agreed upon additionally by the parties. The Customer has the right to use the suspension only once.
8.2 In case of the Customer's refusal to fulfill the contract on the conditions of the Offer, the return of funds paid by the Customer for the Course is made by the Executor upon the Customer's application. The application is sent by e-mail support@cyberyozh.com. The Application should contain the Customer's full name and bank account or bank card details for refund. Funds shall be returned within 10 (ten) days from the date of receipt of the Customer's application by the Executor, unless otherwise provided by law.
8.3 The Executor shall refund money to the Customer less:
- cost of the Course Modules to which the Customer had access before the date of termination of the Agreement under the Offer,
- cost of the Contractor's services included in the Course tariff, which were provided to the Customer prior to the date of termination of the agreement on the terms of the Offer,
- the Contractor's actual costs associated with the provision of services, including the amount of the bank commission for the transfer of funds to the Customer.
8.4 In case of return of funds to the Customer, access to the Course is terminated and the contract is considered to be executed by the Contractor in full on the date of return of funds.
8.5 Payment for telecommunication services to connect the Customer to the Internet, or other local or dedicated networks to provide access to the Internet is carried out by the Customer without the participation of the Contractor. The Contractor shall not be liable for the breach of communication outside its office. The Customer must notify the Executor of possible problems in quality of Internet connection during the classes, if they occur.
8.6 The Customer undertakes to provide himself a personal computer (laptop) for the successful completion of the Course.
8.7 If one of the Parties changes its contact information or other details, it shall promptly inform the other Party.
8.8 The Customer has no unresolved questions about the content of the Agreement, at the time of its adoption until the next update or termination.
8.9 The Contractor reserves the right to amend or supplement any of the terms and conditions of this Contract at any time. All changes in this case are published on the Provider's website. The changes apply to the relations arising after these changes, as well as in case of acceptance of these conditions by the Customer.
8.10. The Executor does not assume responsibility for the compliance of the Course with the Customer's expectations from its completion.
8.11 The Executor does not assume any responsibility for the Customer's actions performed with the use of the Services provided by the Executor.
8.12. The Executor is not liable for the losses incurred by the Customer while using the materials of the Course.

9.1 Any complaints and financial claims are accepted by the Contractor only from the person who accepted the terms of this Agreement-offer (the Customer).
9.2 Claims shall be considered by the Parties within ten (10) calendar days from the date of their receipt in writing by e-mail support@cyberyozh.com, unless other terms are stipulated by the legislation of the Republic of Azerbaijan.
9.3 In the event of any disagreements and disputes due to non-performance or improper performance of this Agreement or in connection therewith, the Parties shall endeavor to resolve them through negotiations and reach an amicable solution or agreement.
9.4 In the event of disagreements and if disputes cannot be resolved by negotiation, their consideration shall be referred to the Arbitration Court of Baku (for legal entities) and the court of general jurisdiction in accordance with the laws of Azerbaijan (for individuals).
9.5 The Contractor shall be entitled to unilaterally terminate this Agreement by giving the Customer three (3) calendar days' prior notice. Notification of termination shall be sent to the Customer by e-mail or through the Executor's support service. Refunds are made in accordance with Section 8 of this Agreement.

10.1 The Customer consents to the Contractor to process his personal data to the extent and in accordance with the Personal Data Processing Policy located at: https://cyberyozh.com/privacy-policy
10.2 The Client may withdraw consent to the processing of personal data at any time by sending the Contractor a notice to the email address of the Contractor support@cyberyozh.com.
